The cost is the problem: six mana for a 3/3 with no immediate effect beyond its keywords is a steep ask in any format where better options exist at every point on the curve.

Merfolk of the Depths is legal across Commander, Legacy, Modern, Pioneer, Vintage, Pauper, and Oathbreaker, but seeing play in almost none of them. In Commander it has niche appeal in Merfolk-tribal builds under commanders like Kumena, Tyrant of Orazca or Sygg, River Guide, where the flash and vigilance at least interact with tap-synergy effects — but six mana is still a lot to ask for a 3/3 body with no enters-the-battlefield effect. In Pauper and Pioneer the card simply doesn't compete: creatures at this price point do far more. Legacy and Vintage don't want it at all.
