In Legacy and Vintage it's legal but irrelevant; the format doesn't care about a conditional 8/8 when it can end the game faster with cheaper threats. Modern is the same story: the condition is too situational in a focused two-player context where opponents aren't reliably flooding the board. Stick to Commander, where the discount is a near-certainty rather than a gamble.
